Apple loses German lawsuit to Motorola Mobility

A German courtroom ruled in favour of Mobility (NYSE:MMI) on Friday, standing behind the cell phone company's claim that 's (NASDAQ:APPL) iPhone and iPad devices illegally use a series of patents owned by .
The Manheim, Germany court ruled that 's core cellular communications patents, related to data packet transfer technology (GPRS), was being infringed, as 's products use the technology, but the company's Ireland-based business doesn't hold a license to sell them.
said the court has granted its requests for an injunction and damages, though it did not specify an amount.
's senior VP and general counsel, Scott Offer said: "We are pleased with the court's ruling. Today's decision validates Mobility's efforts to enforce its patents against 's infringement.
" Mobility has worked hard over the years to build an industry-leading intellectual property portfolio that is
respected by the telecommunications industry, and we are proud to leverage this portfolio to create differentiated innovations that enhance the user experience.
"We will continue to take all necessary steps to protect our intellectual property, as the Company's patent portfolio and licensing agreements with companies both in the U.S. and around the world are critical to our business."
's European spokesman, Alan Hely said the company intends to appeal the decision immediately.
"Holiday shoppers in Germany should have no problem finding the iPad or iPhone they want," he said.
